🌿 Terms and Conditions & Waiver of Liability

Applies to: All Courses, Classes, Workshops, Events, and Programs (Online and In-Person)


1. Acceptance of Terms

By registering for or participating in any program, course, workshop, event, or activity (collectively, “Activities”) offered by The Permaculture Lab, a project of The Farm Lab LLC, you (“Participant”) agree to the following Terms and Conditions and Waiver and Release of Liability.

These terms apply to all formats of engagement, including but not limited to in-person, online, and hybrid learning experiences.


2. Assumption of Risk

You acknowledge and agree that participation in our Activities carries inherent risks, which may include but are not limited to:

  • Physical or emotional injury

  • Illness or exposure to disease (including COVID-19)

  • Property damage or loss

  • Accidents during travel to/from the site

  • Exposure to natural hazards (such as uneven terrain, weather conditions, insects, or plants)

  • Injuries resulting from tools, equipment, or materials used during the Activity

You voluntarily assume all risks associated with participation, whether known or unknown, and accept full responsibility for your participation.


3. Fitness to Participate

By enrolling, you affirm that you are physically, mentally, and emotionally fit to participate in the Activity and have not been advised otherwise by a qualified medical professional. You are solely responsible for ensuring your ability to safely engage in all aspects of the program.


4. Release and Waiver of Liability

In consideration for being permitted to participate, you hereby:

A. RELEASE, WAIVE, AND DISCHARGE The Farm Lab LLC, DBA The Permaculture Lab, its directors, officers, employees, volunteers, instructors, contractors, representatives, and agents from any and all liability for death, disability, illness, injury, loss, or damage to person or property, including claims based on negligence, arising from or related to your participation in any Activity.

B. INDEMNIFY AND HOLD HARMLESS all parties mentioned above against any and all claims, damages, liabilities, or expenses resulting from your participation.


5. Online Learning Disclaimer

You understand that online programs may involve potential risks such as data loss, unauthorized access, or interruptions. The Permaculture Lab is not responsible for technological failures or issues beyond its control, and participation in any online Activity is at your own risk.


6. No Guarantees

The Permaculture Lab makes no guarantees regarding specific outcomes or results from participation in its programs. Information presented is for educational purposes only and is not a substitute for professional advice in areas such as health, safety, legal, or financial matters.


7. Media Consent

You grant The Permaculture Lab the right to record, photograph, and use your image, voice, or likeness in any media, now or hereafter known, for promotional, educational, and archival purposes without compensation. You may opt out of media use by submitting a written request prior to the Activity.


8. Emergency Medical Treatment

In the case of illness or injury, you consent to receive medical treatment deemed necessary by authorized personnel. You agree to bear any cost incurred as a result of such treatment.


9. Conduct and Dismissal

You agree to act respectfully and responsibly toward instructors, other participants, and the land. The Permaculture Lab reserves the right to remove you from any Activity without refund if your conduct is deemed disruptive, harmful, or unsafe.


10. Dispute Resolution & Jurisdiction

In the event of any dispute, claim, or controversy arising out of or relating to your participation in Activities offered by The Permaculture Lab, the parties agree to resolve the matter through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in San Diego County, California, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.

You understand that by agreeing to this clause, you are waiving your right to a trial by jury or to participate in a class action lawsuit.

This agreement shall be governed by and construed in accordance with the laws of the State of California.


11.

Refund Policy
All sales are final upon registration. Due to the limited capacity and planning involved in our programs, The Permaculture Lab does not offer refunds for cancellations, withdrawals, or no-shows.

In certain cases, and at the sole discretion of The Permaculture Lab, partial credit may be offered toward a future course if a cancellation request is made in writing at least 30 days prior to the start of the program. No credit or refund will be granted within 30 days of the program start date.

Please contact us in advance if you are facing extenuating circumstances. We are committed to working with participants when possible to find equitable solutions, including potential transfers to future offerings.

12. Agreement Acknowledgment

By registering or participating in any Activity offered by The Permaculture Lab, you acknowledge that:

  • You have read and understood this agreement.

  • You agree to abide by its terms.

  • You understand that this is a legally binding release of liability.

If you are under 18 years of age, this agreement must be signed by a parent or legal guardian.
